Guilty or Innocent?

Okay, all of you will have heard about Paris Hilton, the 26-year-old socialite. If you don't, no hard feelings but I suggest that you'd better read up. Not all of you may have heard of the latest predicament that she has landed herself in. "What, she was caught red-handed with another celebrity's boyfriend again?" you may say but no, you're all wrong. Sure, she was caught red-handed but not because she was fooling around with another guy. This is way bigger. She was caught driving without a valid driving license. This is an excerpt I got from the Sydney Morning Herald:

A judge sentenced a shocked and tearful Paris Hilton to 45 days in jail on Friday, ruling that the hotel heiress violated her probation for a previous traffic offence by knowingly driving without a valid licence.

And then, 4 days after she was sentenced to jail, she did it again. Tis is something from The London Paper:
Paris Hilton is behind the wheel again just four days after getting a 45-day stretch in an LA jail for driving while banned. Her driving ban is expired so she's not doing anything illegal.
Before this, when she was facing a jail sentence, she told the court that she did not realize that her driving license has been suspended, which is an outright lie according to Yahoo! News:

But the judge said he did not believe Hilton, pointing to a notice she had received from a police officer, and had signed, during another traffic stop in January.

He said Hilton had "completely ignored" that notice, which she had carried in her glove box for weeks, and another license suspension notice sent to her office address by the Department of Motor Vehicles that Hilton said she never saw.

And in true celebrity style, she pushed all the blame on her publicist, Elliot Mintz, who had told her she was permitted to drive for work-related reasons after the first 30 days of her license suspension late last November. .Okay, I'm very confused now. Didn't she just tell the court that she knew nothing of the existence of the suspension letter? How in the world would she know when the date of her non-existent driving suspension will be lifted then?

Then, right after she was sentenced to jail, she appealed that all her fans 'sihn' (oops, sorry, do you mean sign?) a petition in her My Space account that states that her sentence should be terminated. What, does she think that through a petition she can be put above the law? Not only did she violate her probation, she was also driving under the influence. She could have killed some innocent kid, for Christ's sake! And her road to 'stardom' was just an amateur sex video that was circulated widely through the Net. Does this mean that celebrities are above the law? What will happen if every celebrity decides to follow in her footsteps?

And today her sentence has been shortened to 23 days. She should be grateful right? Well, I don't know what she's going to try next. I mean, I don't even know why the newspapers are giving such a wide coverage of this trivial matter. I guess every one loves a juicy gossip :-(

Well, her sentence has been shorten to half. I wonder if the Court did that just because of her celebrity status. What if an ordinary person is convicted of the same offence, who would care?

Anyway, it won't make a difference if Paris go to jail or not. Do you think that she is going to stop?

She did commit the actus reus but as a defence, she could claim that she honestly lacked mens rea but then, arguably, she did omit to take care not to commit the actus reus. I think the Court is right in finding her guilty.

But, anyway, she seems so innocent.
